Level Up Village Privacy Policy

Level Up Village (LUV), a program by Language Testing International, Inc. (LTI), provides online, collaborative courses to participating schools and other educational organizations (hereafter “schools”) around the world with the primary mission of facilitating intercultural communication and multi-cultural learning experiences for students.
Teachers who use the LUV platform will be paired with another global educator to develop a unique learning experience where the students in both classes will interact directly with each other via text messaging and asynchronous video communication. All student communication is moderated by the teacher, administrator, or other authorized school personnel (the “teacher”) who is responsible for administering the LUV learning experience, including the monitoring of all student communications, and obtaining parental consent for students, as required.
This Level Up Village Privacy Policy applies to the LUV website (https://www.levelupvillage.com/), the teacher portal (https://tp.levelupvillageclassroom.com/) and the student portal (http://sp.levelupvillageclassroom.com/). It describes how LUV collects, uses, and discloses (collectively “processes”) the personal information of teachers and students participating in its courses. It also reflects LUV’s compliance with the requirements of the Children’s Online Privacy Protection Act (“COPPA”), the Family Educational Rights and Privacy Act (“FERPA”), and other applicable laws. We suggest that you review this Privacy Policy before signing up for any LUV program or begin using the LUV platform.
Only teachers can register on the LUV platform, connect with a partner teacher, and provide access for their students. The LUV platform does not actively collect personal information from students. Teachers provide a first name and first initial of the last name for each student. The student’s unique username is randomly generated by the platform using the student’s first name and last initial followed by a unique number, as well as a course code provided by the teacher. The course code will only allow students to enroll in the course set up by their teacher. The teacher delivers this information to the students and directs them to a dedicated URL to login. Upon their first log in, students will be prompted to create their own secure password. When using the LUV platform, students will only be allowed to communicate with their own classmates and a single partner classroom which has been set up and is monitored by their teacher. The platform is not to be used by unsupervised students.
Teachers are responsible for administering and controlling the use of the platform video and text message features by students, including students under the age of 13, and obtaining any parental consent for students, as required by applicable laws and policies of the school system.
LUV may occasionally use images, video, and audio of students on its website to demonstrate how its services work and on social networking sites to publicize its courses. When doing so, LUV will obtain the consent of the student’s parents or legal guardians through the participating school.
DE-IDENTIFIED DATA
This Level Up Village Privacy Policy does not apply to any data that has been de-identified, anonymized, or aggregated in such a way that it cannot be linked directly to any individual user. LUV reserves the right to use such non-personal information for its purposes, such as program improvement, system maintenance, or to report on the success of its programs.
INFORMATION THAT THE LUV PLATFORM COLLECTS FROM TEACHERS
When teachers register for an account on the LUV platform, LUV collects the following information. This information is kept confidential and is not shared with other users. No cookies are used on the teacher portal of the LUV platform.
• Teacher’s full name
• Teacher’s email address (school email required)
• Teacher’s username and password
• Teacher’s phone number
• School address and website
Teachers are required to provide a legitimate school email address in order to register for the LUV platform. This email address, along with contact information for the teacher’s school, will be used to validate the teacher’s account and authenticate that only validated teachers have access to the platform. Personal email addresses for teachers will only be allowed if another acceptable means of teacher validation is provided. All schools are required to complete and sign the School Agreement prior to joining an exchange. During the classroom setup process, teachers will be provided with a unique link to the School Agreement. School Agreements must be signed by an authorized school administrator.
The following information is collected as part of the global classroom partner matching process and may be shared, along with any additional information provided, with other teachers using the LUV platform for purposes of facilitating the matching process.
• Teacher’s first name and last initial
• Teacher’s profile description
• Teacher’s geolocation information (city, state, country)
• School name
• School schedule (months school is in session)
• Subjects taught
• Student age ranges
• Class size
• Languages spoken in class and languages taught
Text and Video Communication
Any information posted or uploaded by teachers on the LUV platform with the intent of sharing that information with a partner teacher, such as direct messages, course content, videos, and so on will be made available to the partner teacher. Teachers should not post any information they do not want shared with their partner teacher. The LUV platform will retain copies of all teacher communications for one year to ensure appropriate use of the services. Teachers certify that any information posted does not violate current copyright laws.
INFORMATION THAT THE LUV PLATFORM COLLECTS FROM STUDENTS
The LUV platform does not actively collect personal information directly from students to register for the site. When a teacher sets up a Classroom on the LUV platform, they will be asked to provide students’ first name and first initial of last name which is used to generate a unique username for students. The students’ first name and last initial are shared with the partner class with each video posted by the student. If a student does not want to use their real name, teachers may instead choose to provide any random username. LUV does not collect any personal information (e.g., name, address, or email) from students that would allow someone to directly identify or contact them. No cookies are used on the student portal of the LUV platform.
Text and Video Communication
In order to carry out a peer exchange on the LUV platform, students will communicate directly with their global peers via asynchronous video and text messages. All video and text communication from students is shared exclusively with a single partner classroom and must be approved by the teacher before it is shared with the students in the partner classroom. It is the teacher’s responsibility to ensure that all student communications are appropriate, lawful, and do not convey any personally identifiable information. Any such communications may be blocked by the teacher before they are visible to any other students.
CONTENT RETENTION
LUV retains copies of all student communications for a period of one (1) year to ensure appropriate use of the services and to allow teachers to monitor student progress over the course of the year. Original student video submissions, including any geolocation data associated with those videos, are stored on LUV’s secure S3 servers for no more than seven (7) days to provide for appropriate service needs. The original student videos are converted to the LUV platform standard format before they are shared with the partner institution. During this conversion process, geolocation data are stripped from the student videos and never shared.
Under no circumstances will student communications be shared publicly without the express written consent of students and/or their parents or legal guardians. School districts are required to provide notice and obtain consent from parents or legal guardians to allow students to participate in LUV courses. School districts will be required to provide copies of the parental consent forms upon request.
TECHNICAL INFORMATION COLLECTED FROM TEACHERS ON THE LUV WEBSITE
The LUV website collects the following technical information automatically from users. This information is only used for internal analytics to improve the functionality of the services that LUV offers. The LUV website is intended for teachers only.
• Device Information: Information about the device used to access the LUV website, including IP address, browser information, model, and operating system
• Usage Information: Third-party services, including cookies, collect information about page visits, logins, websites visited before and after accessing the LUV website, features used, frequency of visits, time on page, and links clicked. (Note: You may disable cookies through your browser settings, if desired, however, without cookies some aspects of the LUV website may not function as intended.)
INFORMATION THAT LUV SHARES
LUV does not sell or rent personal information to any third party. It uses service providers who may need access to teacher and student personal data to provide their services. They are contractually required to treat such personal data as confidential and to use it only to provide the requested services.
No information is ever used to contact a student, to build a profile of them, or to conduct behavioral advertising.

LUV reserves the right to share information that it collects from users:
• with its parent company or subsidiaries;
• in compliance with any legal obligations or to protect its users and service providers (e.g., in connection with an ongoing investigation or violation of its Terms of Use);
• in any corporate transaction, such as the sale, merger, or acquisition of LUV; and
• with registered teachers to provide our partner matching service.
USER ACCESS TO STORED INFORMATION
A registered teacher with access to the LUV platform may be able to edit, change, or delete stored information through the user profile settings or by contacting support@levelupvillage.com. Teachers cannot change their email address as this is the unique username used to keep the account open. LUV will retain teacher account information for as long as the account is active.
If a student or their parent or legal guardian would like to request access, review, or delete the student’s information, they may contact the student’s teacher. The teacher should contact support@levelupvillage.com to request modification or the permanent deletion of student text or video communications.
DELETE TEACHER ACCOUNTS
To permanently delete a LUV platform teacher account, please contact support@levelupvillage.com. Teacher accounts will remain active until a request to delete the account is received. After an account is deleted, teacher information will be used only as required to comply with any legal obligations, to resolve disputes, or to enforce any contractual agreements.
OPT OUT
Teachers may opt out of providing some personal information on the LUV platform. However, teachers should provide as much information as possible to facilitate the matching process. Teachers cannot opt out of providing any information required to register for an account (e.g., email address) and to use the platform.
Teachers may opt of out of receiving email or marketing communications from LUV by using the unsubscribe link in any marketing email they receive or by contacting support@levelupvillage.com. Requests to unsubscribe may take up to ten (10) days to process.
No personal information is collected from students when creating an account or during the program. All student-contributed information on the LUV platform (text and video communications) is optional and provided by students on a voluntary basis. Only teachers can register their students to use the LUV platform.
THIRD-PARTY WEBSITES
LUV may provide links to websites operated by third parties. LUV does not control their privacy policies, and as such, encourages you to review the privacy policy of any third-party website that you visit.
INTERNATIONAL TRANSFER
LUV courses are global. Personal information collected and contributed in one country will be transferred to countries with different privacy and data protection laws. In particular, personal data collected in the European Union will be transferred, stored, and processed in the United States. The laws of the United States may be less restrictive than the laws of your country of residence. By using LUV, you are consenting to the voluntary transfer of your personal information to facilities in the United States.
INFORMATION SECURITY
LUV takes great measures to ensure the security of its system and any information that it collects from users. To maintain the confidentiality, security, and integrity of any personal information stored on its system, LUV uses industry-standard information security and operational best practices. User passwords should never be shared with anyone. It is the user’s responsibility to maintain the security of their password and change it regularly.
DATA BREACH NOTIFICATION
LUV will promptly notify the School District of any breach or unauthorized release of PII received from the School District in the most expedient way possible and without unreasonable delay, but no more than seven (7) calendar days after it has discovered or been informed of the breach or unauthorized release. LUV will cooperate with the School District and provide as much information as possible, including but not limited to:
• a description of the incident,
• the date of the incident,
• the date LUV discovered or was informed of the incident,
• a description of the PII involved,
• an estimate of the number of records affected,
• the schools within the district affected,
• what LUV has done or plans to do to investigate the incident, stop the breach and mitigate any further unauthorized access or release of PII,
• and contact information for LUV representatives who can assist affected individuals that may have additional questions.
CHANGES TO THIS PRIVACY POLICY
LUV may update this Level Up Village Privacy Policy at any time. The date at the top indicates when the last update was made. If LUV makes a material change to this policy or to the way it collects and processes personal information, it will post notice on the site and contact all registered teachers on the platform via the email address provided prior to making the change. Since LUV does not collect student emails, it is the responsibility of the teacher to review the updated policy and share that information with students and their parents or legal guardians, if required.
